Presentation on Planning Guidelines

Minutes:

The Planning Officer gave a short presentation on guidelines that had to be taken into account when determining planning applications; in particular the issues that could, and could not, be taken into account. This was set against the broader policy framework.

Planning Application - Land adjacent, The Mazels, Knowle Lane, Horton Heath, Eastleigh, SO50 7DZ DOCX 195 KB

            Outline: residential development for up to 4no. Dwellings with access

            from Knowle lane (access only, all other matters reserved)     (Ref.O/17/79795)    

Minutes:

The Committee considered the report of the Head of Development Management (Agenda item 6) concerning an Outline Application for a residential development for up to 4no. Dwellings with access from Knowle lane (access only, all other matters reserved). (Ref. O/17/79795).

 

The committee was advised of the following updates;

 

·         No further representations had been received;

·         No comments had been received from the Head of Planning, Policy and Regeneration;

·         No comments had been received from the Environment Agency.

 

RESOLVED –

 

That permission be REFUSED for the reasons set out in the report.

 

(NOTE: The applicant and one member of the public spoke in support of the application.)

Planning Application - Fir Tree Farm and Victoria Farmhouse, Firtree Lane, Horton Heath, Eastleigh, SO50 7DF. DOCX 1 MB

            Outline application: construction of up to 450 dwellings with new road

            and access onto fir tree lane and Allington lane. With associated

            highway modifications, infrastructure, public open space, landscaping

            and drainage. Detailed matter for consideration-access. The proposal

            effects the setting of a listed building, effects a public right of way

            and is subject to an environmental impact assessment. The development

            is contrary to the development plan.(Ref. O/16/79354).

The Committee considered the report of the Head of Development Management (Agenda item 7) concerning an Outline Application for construction of up to 450 dwellings with new road and access onto fir tree lane and Allington lane. With associated highway modifications, infrastructure, public open space, landscaping and drainage. Detailed matter for consideration - access. The proposal effects the setting of a listed building, effects a public right of way and is subject to an environmental impact assessment. The development is contrary to the development plan. (Ref: O/16/79354).

 

The Committee was advised of the following amendments to the report and additional updates;

Paragraph 179, which considers the development at West of Horton Heath and the link road advising, should read “…it will also be necessary to include an Obligation to ensure the development proposal is not commenced until such time as relevant infrastructure at the West Horton Heath site is secured or underway, and is not occupied until the same infrastructure at West Horton Heath has been completed or provided.”


Condition amendments

 

Condition 5 – Design details; this should reference “condition 4” on the third line and not “condition 5.”

 

Condition 12 – Bats; the first three bullet points should be deleted as this is a duplication of the wording.

 

Condition 23 – Conservation land; there is a duplication of wording.  The three lines of text prior to “Reason; to minimise…” should be deleted.

Representations received

 

One additional letter from a Fair Oak Road property had been received following directed consultation of principle road changes at Allington Lane / Fair Oak Road with comments/objections as follows;

·         No objection in principle to the road changes, but seek clarification on impact on drive and footway;

·         Objection to principle of additional housing and inadequate highway capacity.


Additional information

 

Natural England to confirm they are in agreement with the Habitat Regulations Assessment conclusions reached by Eastleigh Borough Council.

RESOLVED -

 

That outline permission be GRANTED subject to:

 

(1)         The recommended conditions and reasons;

(2)         As per Members’ request, a Note to Applicant be added in the drafting of the Construction Traffic Management Plan as required by condition 27, which states that the lorry routing plan shall be designed to avoid HGVs from using Allington Lane south of its junction with Fir Tree Lane, either for entering or leaving the site;
 

(3)         Comments from Natural England on the Borough Council’s screening under the Habitats Regulation;

(4)         Completion of a Section 106 agreement.

 

(NOTEs: (a) Two members of the public and the Chair of the Burnett’s Lane Resident’s Association made representations against the development citing a number of concerns including; traffic impact upon local roads; traffic impact on wider roads including Junction 7 of the M27; building height and the urbanising impact in the middle of the countryside; the impact on medical facilities –  the approved West of Horton Heath application initially included a Doctor’s Surgery which has since been removed from the plans; impact on the wildlife; the flood risk –  flooding has already affected local residents; and  (b) the agents spoke in support of the application.)

Planning Application - Land adjacent Bradshaw Close, Fair Oak, Eastleigh, SO50 7BS DOCX 230 KB

Construction of 4No. three bedroom semi-detached dwellings with associated parking, visitor parking, access, amenity space, and bin and cycle storage provision, on land adjoining Bradshaw Close.

Minutes:

The Chairman advised that Item 8 had been deferred to the meeting in June 2017 to ensure that additional information regarding the application could be considered.

Planning Appeals

The Head of Legal and Democratic Services to report:-

 

(a)          that the following appeals have been lodged:-

 

·         Land adjacent to 12 Cherry Drove, Horton Heath, SO50 7DS.

Appeal against the Council’s refusal of planning permission for the Extension & conversion of existing garage to provide 1no. one bed detached dwelling with associated parking & amenity space.

·         Land to rear of 70 and 72 Stoke Common Road, Bishopstoke, SO50 6DU

Appeal against the Council’s refusal of planning permission for the erection of 1no. 2 bed dwelling with attached garage & associated parking & landscaping with access from Jockey Lane.
