That the minutes of the meeting held on 26 July 2018 be confirmed

and signed by the Chair as a correct record.

22.

Public Participation

Minutes:

Local Resident, Andrew Thompson spoke in regards of the Hamble Anti-aircraft gun emplacement on Hamble Common. The concrete structure, on which the gun was positioned, was collapsing and some urgent action was required.

 

The Chair confirmed that Historic England had been contacted and that engineering reports were now ready. A response from Historic England was awaited. Once all the preparatory work was conducted, a final decision on the most appropriate action can be taken.  The Local Area Manager also agreed to contact Historic England to ask for advice regarding short term protection measures.

Declarations of Interest

Members are invited to declare interests in relation to items of business on the agenda.  Any interests declared will be recorded in the Minutes.

Minutes:

Councillor Jane Rich declared a Pecuniary Interest in agenda item 8, Planning Application - Hilltop, West End Road, Bursledon SO31 8BP, because she was personally involved in the running of a nursery in the area. She left the room and did not vote.

 

Councillor Tonia Craig declared a Non Pecuniary Interest in agenda item 8, Planning Application - Hilltop, West End Road, Bursledon SO31 8BP, because she attended school with the applicant. She took part in the discussion and the vote.

 

Councillor Jane Rich declared a Non Pecuniary Interest in agenda item 9, Planning Application - Brownfield Site Blundell Lane, Bursledon, Southampton, SO31 8AL, because she knew the applicants father. She took part in the discussion and the vote.

Community Investment Programme - Report of the Local Area Manager pdf icon PDF 64 KB

Minutes:

The Committee considered the report of the Local Area Manager which

detailed a number of projects and schemes to improve the prosperity,

environment and wellbeing of residents in the Bursledon, Hamble-le-Rice

and Hound area.

 

RESOLVED – The the use of £14,734 of Developers Contributions for

new play equipment at Bartletts Field, Hamble-le-Rice be approved.

Minutes:

The Committee considered the report of the Local Area Manager which

detailed a list of community grants . The Bursledon, Hamble-le-Rice and Hound Local Area Committee had a small budget which it allocated to local community grants. Local Area Committee received applications through the year with the funds reducing towards the end of year.

 

RESOLVED –

 

That the the community grants as outlined in appendix 1 of the report be approved.

 

(NOTE: Community grants listed in the appendix 1 of the report were received by the following organisations: TS Mercury Old Boys Association, Hamble Valley Tourism, Hamble-le-Rice Flower Club, Hound Parish Council, Bursledon Lunch Club.)

Presentation on Planning Guidelines

Minutes:

Development Management staff gave a short presentation on guidelines that had to be taken into account when determining planning applications; in particular the issues that could, and could not, be taken into account.  This was set against the broader policy framework.

27.

Planning Application - Hilltop, West End Road, Bursledon SO31 8BP DOCX 200 KB

Change of use from C2 Residential Care Home to a D1 Registered Nursery and the addition of an attached C3 Flat. (Ref. F/18/83038)

Minutes:

The Committee considered the report of the Lead Specialist for Housing and Development  (Agenda item 8) concerning an application for a change of use from C2 Residential Care Home to a D1 Registered Nursery and

the addition of an attached C3 Flat; (Ref: F/18/83038 ).

 

The Committee was advised that there were following updates:

 

·         Change of application description to: Change of use to a D1 Registered Nursery and the addition of an attached C3 flat.

 

·         Further objections were received:

Bursledon Parish Council - Objection on the following grounds:

 

      Access

      Increase in vehicular movements and parking around the site.

      No outside provision for children’s play area

      Lack of site capacity for proposed change of use which would have an adverse effect on residents

 

Comments received from 7 local residents – Objection on the following grounds (summarised):

 

      Amenity – insufficient play space for children.  Located very close to major roads that do not have pathways for safe crossing and no bus service.

      Parking – insufficient parking pushing vehicles onto road and further down Peewit Hill where there was already insufficient parking.

      Traffic – already busy especially at peak times, would lead to more congestion and waiting times for turning traffic.

      Trees – concern re: loss of oak tree very close to access

     No need as several nurseries and playgroups in local area

 

RESOLVED – That the application be REFUSED as per the recommendations and reasons.

 

 

(Note: 1)The agent spoke in support of the application. 2)Councillor Rich declared a pecuniary interest , left the room and did not vote 3) Councillor Craig declared a non-pecuniary interest, remained in the room, took part in the discussion and voted thereon.)

Planning Application - Brownfield Site Blundell Lane, Bursledon, Southampton, SO31 8AL DOCX 309 KB

Conversion and redevelopment of site to provide 1no. 2 bed dwelling. (Ref.F/18/82248).

 

Minutes:

The Committee considered the report of the Lead Specialist for Housing

and Development (Agenda Item 9) for conversion and redevelopment of site to provide 1no. 2 bed dwelling.(Ref.F/18/82248).

 

The committee was advised of the following amendments to report:

 

·         Paragraph 1 (1st sentence) should read: “The proposal is for the construction of 1no. 2-bed detached dwelling…”

·         Paragraph 35 (1st sentence) should read: “The relevant policies of the adopted Local Plan are considered to be up-to-date and as such the presumption in favour of sustainable development in paragraph 11 of the NPPF is not triggered.  However, for completeness this report considers whether any adverse impacts of approving the development proposed would significantly and demonstrably outweigh the benefits (the planning balance)…

·         Paragraph 48 (last sentence) should read: “The proposed development in this instance falls within this threshold and as such no planning obligations can be requested other than the contribution towards the Solent Recreational Mitigation Strategy referred to in paragraph 47.

 

The committee was advised of the following amended recommendations:

 

·         Amended reason for refusal no.1:

By virtue of the scale, bulk and design of the proposed dwelling, the development would appear incongruous and at odds with the prevailing character of area of the area contrary to Saved Policy 59.BE of the Eastleigh Borough Local Plan (2001 - 2011), policy DM1 of the emerging Eastleigh Borough Local Plan (2016- 2036) and the provisions of paragraphs 124, 130 and 131 of the National Planning Policy Framework

 

·         Amended reason for refusal no. 3

The application fails to secure mitigation against recreational pressure impact from the development on the Solent and Southampton Water Special Protection Area. As such the proposals are contrary to the Conservation of Natural Habitats and Species Regulations 2010, Policy DM9 of the Submitted Eastleigh Borough Local Plan (2011-2029), Policy DM11 of the Emerging Eastleigh Borough Local Plan (2016-2036) and the National Planning Policy Framework.

 

 

RESOLVED –

 

That the decision be delegated back to the Lead Specialist for Housing and Development in consultation with the Chair and Vice Chair to PERMIT subject to:

 

(1)  Securing of the payment of the financial contribution towards the Solent Recreation Mitigation Strategy; and

(2)  Finalising the wording of conditions, which are to at least include conditions relating to time period for permission, materials, tree protection, provision of access and parking, hours of work, construction vehicles, no burning on site, landscaping and ecological mitigation.

 

(NOTES: a)Councillor Rich declared a non-pecuniary interest, remained in the room and voted. b)The applicant spoke in support of the application. c) Members decided to approve the application despite the planning officer’s recommendation to refuse because they did not oppose the design and thought that the proposed dwelling would be of merit to the neighbouring area. They also welcomed the redevelopment of a brownfield site. Development Management Senior Specialist reminded Members an arboricultural report was needed to enable the extent of the tree works required to accommodate the proposed development to be considered and assessed.  Without the arboricultural report it has not been possible to assess the extent of the tree works and the impact of them on the future health of the tree, or the potential impact on any bat roosts, foraging and commuting corridors resulting from the tree works.  As bats are a protected species this would mean that the local planning authority could not meet its obligations under the relevant legislation, hence the 2nd suggested reason for refusal.  Members expressed some concern but concluded that the tree survey and any necessary bat mitigation should be conditioned and permission granted.)

The Committee considered the report of the Lead Specialist for Housing

And Development (Agenda Item 10) for a display of 1no. non illuminated fascia sign on south elevation. (Ref. A/18/83603).

 

The committee was advised of following change to description of the application: Description of proposal changed to retention of sign as it has already been displayed.

 

The committee was advised of following amendment to the report:

It was confirmed that the advert is 368mm in height and not 3.68m as per paragraph 2.

 

RESOLVED –

 

That the application be PERMITTED subject to the recommended condition and reasons.

Deacons Boatyard, Bridge Road, Bursledon SO31 8AZ. Appeal against a refusal to grant a planning permission for alterations to marina layout and the installation of public access pontoon. (Ref. F/17/80845).

 

This was an LAC decision.

     

 

(b)          that the following appeals have been dismissed:-

 

Land adjacent to The Roll Call, Woolston Road, Netley Abbey SO31 5FJ.Appeal against the Council’s refusal of proposed development - the erection of a bungalow with accommodation in the roof space following demolition of existing building, removal of stored vehicles and mobile home and cessation of vehicle storage use (Use Class B8) and cessation of recreational use (Use Class D2). (Ref. F/17/80875).

 

This was an LAC decision.

 

10 Beverley Gardens, Bursledon, Southampton SO31 8FD

The appeal is made against the decision of Eastleigh Borough Council to refuse an application for an enlargement of the dormer roof.

(Ref. H/18/82311).

 

This was a delegated decision.
