The application to Review


The Clerk outlined that the application to review by Hampshire Constabulary had been made on 24 February, on the grounds of prevention of crime and disorder and public safety. 


Subsequent to changes at the premises, which included transfer of the licence and change of Designated Premises Supervisor (DPS) the Police’ concerns no longer existed current.

Sergeant Gavin Smith attended on behalf of Hampshire Constabulary and presented their representation, previously submitted in writing. He reiterated his email of 20th March.  In this he stated that since the replacement of Mr Timson as DPS and the appointment of Jamie Carter in this role his previous concerns had fallen away and he expressed the wish that the new DPS be given the opportunity to remedy any issues outstanding at the club. 


The legal advisor confirmed under the current legislation there was no mechanism for the Police to withdraw their request for a Review, and therefore a hearing had to be convened. 


The current DPS stated he had looked at previous Police concerns with the DPS and was addressing these issues. He felt things were looking considerably better.  He was keen to work with the Police, and Sergeant Smith in turn stated he would welcome a safe environment in Eastleigh for a night time economy. 


The Decision

The Panel withdraw to make their decision 


The Panel did not withdraw from the room and announced their decision that in view of the fact that the grounds for the review had fallen away, and that this had been confirmed by the Police, the licence should continue in its current form – unchanged. 


The full details of the decision together with reasons for granting would be forwarded to all the parties and posted on the Council’s website as soon as possible.
