RESOLVED –

 

That the Minutes of the meeting held on 9 September 2015 be confirmed and signed by the Chair as a correct record subject to the following corrections: Page 2 should state Ageas and not Ageas Bowl as printed, and page 3 regarding funding for the scout and guide huts, only the guide hut was well on the way to completion.

Chairman's report

Minutes:

Although Councillor Grajewski was unable to attend at the meeting the Chair congratulated her on her appointment as a County Councillor. The Committee welcomed Andy Thompson to his first meeting as the Local Area Co-ordinator, and also the new technical team.

Area Co-ordinator's Report

Minutes:

Andrew Thompson introduced himself as the new Area Co-ordinator explaining he had worked for the Council for 14 years.  He then gave a short history of his time whilst at the Council.  Since taking up the post he explained he had taken the opportunity to meet with some groups and individuals including the Parish Clerk and visited Thornden School for their presentation evening, and had found the students achievements inspiring.

 

Moving forward he was keen to continue introducing himself to existing groups and partners and help to support them.  He felt his biggest task would be to investigate new avenues for partnership funding, grants, sponsorship – given the limited budgets available to the Local Area Committee.

 

Mr Thompson thanked Members for their patience over this period of overlap between this new role and the continuing responsibilities of his existing role.

Presentation on Planning Guidelines

Minutes:

Development Management staff gave a short presentation on guidelines that had to be taken into account when determining planning applications; in particular the issues that could, and could not, be taken into account.  This was set against the broader policy framework.

Change of use of land to private garden: Retrospective (amended description). (Ref. F/15/76762)

Minutes:

The Committee considered the report of the Head of Development Management (Agenda item 8) concerning a retrospective application for change of use of land to private garden: (amended description). (Ref. F/15/76762)

 

The Committee was advised, and the legal officers confirmed, that:

 

-   Legal position of the path had been investigated.

-   The path was not shown on the County Council’s ‘definitive map’ and was not therefore currently recognised by them as a public right of way.

-   Loss of a private right of way (an easement) was a private matter and not a material planning consideration.

 

Members voiced concern at the loss of a footpath and the resulting impact upon the amenity for the residents of South Millers Dale and questioned whether other well used, but unadopted footpaths, were in danger of being lost, expressing the need to avoid setting a precedent.

 

RESOLVED –

 

That permission be REFUSED on the grounds of amenity and area character, with the final decision delegated to the Head of Development Management in consultation with the Chair, Vice Chair and member of the opposition party to agree the exact wording of the reason for refusal. 

 

(NOTES: a) In her absence a statement was read out from Councillor Atkinson expressing her concern regarding the loss of a footpath; and b) The applicant spoke in support of his application explaining he had undertaken a substantial amount of research and this was an unadopted footpath and was now within his ownership.)

The Committee was advised of the following updates:

 

-  No representations received.

-  No further consultee comments.

 

RESOLVED -

 

That permission be GRANTED subject to:

 

(1)  The following amendment to Condition 4 (c):

“the arrangements for deliveries associated with all construction works, loading/ unloading of plant & materials, protection of trees along the site access and restoration of any damage to the highway including vehicle crossovers and grass verges, Reason: To limit the impact the development has on the amenity of the locality and protected trees”; and

 

(2)  The recommended conditions and reasons.

 

(NOTE: Councillor Olson declared an interest in this item and left the room taking no part in debate or voting thereon.)

Minutes:

Consideration was given to a report of the Area Co-ordinator which outlined that fees and charges for Council services were reviewed on a regular basis.  In accordance with the Budget Strategy approved by Cabinet in September, fees and charges levied by the Council were being reviewed with the intention of increases being introduced with effect from January 2016 where possible.

 

Members were advised there had been a typing error in paragraph 4 of the report which should have read 4% above inflation and not 1% as printed.

 

RESOLVED –

 

That the Cemeteries fees and charges to come into effect from 1 January 2016 be approved.

 

(NOTE: In her absence a statement from Councillor Atkinson was read out, which expressed concern at the level of charges for burials which seemed higher than other adjacent districts.)

Motion: Ban on HGVs - to consider the following motion submitted by Councillor A Broadhurst:-

"This Local Area Committee urges Hampshire County County Council to implement a ban on HGV's using the area bounded by Hocombe, Winchester and Hursley Roads other than when delivering to premises within the area as first promised by HCC in 1999"

Councillor Alan Broadhurst introduced his motion which stated: "This Local Area Committee urges Hampshire County Council to implement a ban on HGV's using the area bounded by Hocombe, Winchester and Hursley Roads other than when delivering to premises within the area as first promised by Hampshire County Council in 1999."

 

RESOLVED-

 

That the motion be ADOPTED.

 

(NOTE: In her absence a statement from Councillor Atkinson was read out which stated her view that there was a need to join with Test Valley and Otterbourne authorities to  work on a plan to create a proper link road from Test Valley to the M3.)
