Fees and Charges for Council services are reviewed of a regular basis (paper 4).

 

Consideration

 

In accordance with the Budget Plan, fees and charges levied by the Council are being reviewed with the intention of increases being introduced, where possible, with effect from January 2020.

 

RESOLVED –

 

That Cabinet approves the following:

 

(1)  All proposed fees and charges in Appendices 1 to 9 to come into effect on the dates outlined in the report; and

 

(2)  That the town centre car parking charges should remain unchanged for 2020/21.

Article 4 Direction - Old Bursledon Conservation Area pdf icon PDF 104 KB

Issue

 

Concerns have been raised regarding risks to the character and appearance of the Old Bursledon Conservation Area (OBCA) through development granted under national Permitted Development rights (paper 5).

 

Consideration

 

The Local Planning Authority has explored opportunities to bring into force an Article 4 Direction within the OBCA to remove the right to undertake specified householder development without applying to the Local Planning Authority for planning permission.

 

RESOLVED –

 

That Cabinet:

 

(1)  Approves the principle of putting in place an Article 4 Direction within the Old Bursledon Conservation Area (OBCA), subject to consultation;

 

(2)  Confirms the Article 4 Direction shall take the form of an immediate direction;

 

(3)  Approves the preparation and serving of an Article 4 Direction and the associated consultation documentation; and

 

(4)  Confirms the Local Area Committee can approve bringing the Direction into force following a report to the Local Area Committee setting out the conclusions of the consultation process.

The Council submitted its draft Local Plan in October 2018 according to its Local Development Scheme (paper 5a).

 

Consideration

 

Since the submission key stakeholders have been preparing statements and evidence for the Examination in Public of the draft Eastleigh Borough Local Plan.

 

RESOLVED –

 

That Cabinet notes the progress made by the Council in preparation for the Examination in Public of the draft Local Plan, in particular the level of cooperation on key issues with a range of partners.

Exempt Business

To consider passing a resolution under Section 100A(4) of the Local Government Act 1972 in respect of the following item(s) of business on the grounds that it is/they are likely to involve the disclosure of exempt information as defined in paragraph(s) 3 of Part 1 of Schedule 12A of the Act.

 

The Schedule 12A categories have been amended and are now subject to the public interest test, in accordance with the Freedom of Information Act 2000.  This came into effect on 1st March 2006.

 

It is considered that the following items are exempt from disclosure and that the public interest in not disclosing the information outweighs the public interest in disclosing the information.

(1)  That, in pursuance of Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting for the following items of business on the grounds that they are likely to involve the disclosure of exempt information as defined in paragraph 3 of Part 1 of Schedule 12A of the Act; and

 

(2)  That, in pursuance of the public interest test, the public interest in disclosing the information contained in the following item of business was outweighed by the public interest in maintaining the exemption.
